AT GREEN EMERALD CLEAN, WE HAVE CREATED A SOLID FOUNDATION BY BEING A TRUE INNOVATOR IN THE INDUSTRY. WE LOVE WHAT WE DO AND WANT NOTHING MORE THAN TO PROVIDE OUR CUSTOMERS WITH THE HIGHEST CLASS CUSTOMER SERVICE AND THE BEST CLEANING AND LAWN SERVICES ON THE MARKET.
Terms and Conditions
Green Emerald Clean, LLC Residential and Commercial Contract for Services
Here at Green Emerald Clean, we want all out clients to understand our service expectations. We feel it is important to be fully informed on the services and our expectations. Please fully review and let us know if you have any questions or concerns about any information contained in our agreement. We will require you to verify that you read and understand the terms and conditions agreement before we commence any work.
Acceptance of Terms
By accepting an estimate, the client agrees to all the terms and conditions in this agreement. You authorize the company to do the work as specified on the estimate. You release our company from property damage unless negligence or willful misconducts that cause structural damage. The company is not responsible for damage to lose siding, paint, wood, trim or windows that was previously noted as damaged or found during pre-inspection walk through.
Binding Agreement
The services the company provide to you are subject to the following terms and we reserve the right to updated the terms and conditions any time without notice to you. You can review the terms and conditions by clicking on the terms and conditions links via our website, email communications such as estimate or invoice links.
This document serves as a binding agreement between the property owner, hereby identified as “client,” and Green Emerald Clean, LLC and its agents, owners, employees and subcontractors, hereby identified as “Company,” for the execution of services in exchange for payment for Residential and or Commercial services.
Permissions
Client or his/her agent agrees to allow Company on the property for the purposes of cleaning services. Client understands that there is no set timeframe for the completion of services and several visits to the property may be required. Company also has the permission to visit the property with little or no notice to assess service needs prior to the date of service, as well as to check completion after services have been rendered.
Client understands that the services will be completed in the timeframe given during the estimate. Due to unforeseen circumstances such as bad weather, the cleaning service may need to be moved to the next available business day. Client understands that the company will do their best to accommodate for a quick reschedule but must work around other scheduled clients and weather.
Client agrees to allow company to utilize their Residential and or Commercial water source via outdoor spigot, which will be turned on and easily
accessible on the date of service. If on well water, or if in an area with low water pressure or volume, client agrees to cease
all water consumption inside the home or business to include faucets, dishwashers, washing machines, outdoor sprinkler systems etc.
Acknowledgment of Risks and Releases of Liability
Power Washing uses high pressure and caustic chemicals to clean difficult stains off of exterior surfaces. Utilizing this pressure allows the best clean possible; however operating at such high pressure can also cause damage. Green Emerald Clean, LLC’s technicians are well trained in utilizing their equipment and take the upmost precautions in making sure the company does not cause harm to your investment. Although high pressure is not used on Residential and or Commercial siding, damage can still occur due to poor maintenance, neglect to the property, and/or low grade building materials. Owners should consult with their builder to insure that their home’s or business materials are able to be pressure washed. It is the responsibility of the owner to insure that their property has been maintained in accordance with its manufacture’s recommendations and any defects or areas of concern are repaired prior to washing to insure a watertight, surface. The Owner assumes all of these risks and takes responsibility for any damage that occurs due to the above explanations. On the date of service, the Company will walk around the property and provide the client with a written examination of pre-existing damage. This document is not all encompassing, as new damage can become apparent while the surfaces are being cleaned. When new damage is found, the Company will cease all cleaning efforts until the client can see the damage and acknowledge its existence.
The Client also agrees to release the Company of any or all liability for injuries sustained due to equipment placement to include injuries from tripping/falling, striking equipment, falling debris or equipment.
Oxidation
Client understands that any blemish or flaw or any existing oxidation will be more noticeable after cleaning. Homes and or businesses that have not been maintained or has contact with sun exposure will be susceptible to oxidation. Signs of oxidation are as follows: chalky white powder on siding and the clear luster removed. Please understand if your home or business suffers from oxidation, you may see this difference after a cleaning. When a home and or business is covered with debris, those blemishes may not stand out as much as it would be after cleaning. Most of the time those issues are pointed out to the client during the estimate inspection. Client understands that the company may not find every flaw and is not liable if it is more noticeable after a cleaning. Client understands we do provide an added optional cleaning service for oxidation removal and this is an added cost. This service is vastly different from a basic cleaning wash.
Weep Holes
Client understands that our cleaning is specifically designed and will not cause any discoloration or damage to the siding. Client understands that if their property is severely covered in grime that they could potentially have issues with weep holes. If faint rusty color on your siding this maybe due to weep holes draining. This will normally come off with morning dew or rain. If they weep holes runs are heavy you can use a garden hose to rinse down after cleaning has been completed.
Window Cleaning
Client understands that during a cleaning that you will receive a basic window cleaning. This is different from windows being done for a spot free finish. A basic window wash will get debris off windows, but could leave water spot, especially if you have hard water.
If you are looking for spot free windows you will want to add this to your cleaning service separately.
Gutter Cleaning
Client understands that only exterior gutters are cleaning for a wash service. If a client wants the interior gutters cleaned, the is considered an additional service and can be requested an charged separately.
Roof Treatment
When the company completes a roof wash which is a separate service from a wash, the client understands that all roofs react to our solution differently and results will vary. Our solution is guaranteed to completely kill any damaging growths such as algae, moss, lichen. Client understands that the roof will show results of cleaning but in some instances, it may take more time to remove dead growth with wind and rain. This happens due to may factors such as age of the roof, type of shingle, location, and amount of buildup.
Client understands that we do not pull or force growths off from the roof material as it could cause damage. If a client is insistent on having growths forcibly removed they must sign a waiver that they release all liability to the company for any damage and void the roof warranty.
Roof Granular Loss
Client understands that roofs over time have granular loss which normal breakdown. Granular loss occurs when it is infected with organic matter which diminishes roof life faster. Client understands that moss and lichen eat through the roofing material faster than algae and there is potential for more significant granular loss in the areas. Client understands that after a roof cleaning, you may see these areas of granular loss clearer that before because this is no longer organic matter hiding it. These is nothing you can do to avoid granular loss after an infection other that monitor the life of the shingle. Client also understand that our cleaning solution is specifically designed for cleaning and will not cause nay discoloration or damage to the roof.
Rust
Client understands that rust marks will be washed but not removed. The rust marks may lighten with a standard washing but will not be removed completely. To have them removed is another service specifically for rust removal and is a separate charge. Not all rust can be removed if rust has penetrated deep enough due to lack of client care and may leave marks or rings even after treatment.
Oil Stains
Client understands that oil stains will be washed on driveways but not removed. The oil stains may lighten with a standard concrete wash but will not be removed completely. The have the oil stains removed is a separate service specifically for oil removal and is a separate charge. Not all oil can be removed if oil has penetrated the pad do to lack of client care and may leave marks or rings even after treatment.
Stains
Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means. We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.
Client Responsibility On The Day of Service: 4-6 hours before service time
Please have a water spigot activated and accessible
Please have all windows & doors shut tightly.
Please have all pets inside and pets or animal waste removed from property.
Clear the work areas of all items and remove all flags, doormats, vehicles, or sensitive materials from the areas being washed.
The Company suggests the Client utilize their property’s breaker box to shut off power to any and all exterior outlets, light fixtures, or any other electrically powered features. This is especially important to outlets that are not covered with exterior covers. Also, removing or opening any window screens will allow the Company to thoroughly clean windowsills. Removal of these screens will also allow for even distribution of detergent and streak-free drying. It is also vital to the preservation of the Client’s property that they notify the Company of any surfaces that cannot be cleaned with high alkaline or acidotic detergents (see exclusions below).
Exclusions:
There is a $100.00 deposit due to hold your service day scheduled. This will be applied to the total after work it completed.
There is a $100.00 cancellation fee if notice is not given within 24 hours of service, or if the Company arrives and cannot wash due to steps 1-4 not being completed.
There is a $50.00 Processing fee for any returned checks.
There is a $75 per hour charge to clear items from work area with a minimum of 1 hr charge.
These is a $50 per pet waste pile that has to be removed. This includes but not limited to domestic or wild animal waste droppings. Maximum charge of $500 for animal waste pickup.
The Company is not responsible for water intrusion. While every effort is made to prevent this from happening, bad seals around windows and doors and cracks in concrete foundations can make this unavoidable.
The Company is not responsible for the rare “fogging” effect that happens to multi pane windows with bad seals.
This agreement to provide services is in no way a guarantee that stains will be removed completely. The Company does strive for a 100% customer satisfaction, and will work with owners when this does not occur.
Notify the Company if there are any surfaces on or near the home or business that cannot have any form of detergent on them. If the company is not notified of this, The Company is not responsible for any ill effects to any surfaces regarding this matter.
Media Release
Client agrees to allow Company to utilize any photos, descriptions, reviews, quotes, or videos of the property and/or the client in the context of marketing or advertising for the Company. The company will use these items described in this section without any compensation to the Client. Client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. This does include the use of photos, addresses, testimonials and videos posted or displayed on online venues such as social media and or the Company’s website. The Client also agrees to allow the Company to display a marketing sign on their property for no more than one week (seven calendar days). Any damage to this sign will be charged to the client at full retail cost.
Corrections of Damages
Green Emerald Clean, LLC shall only be obligated under this Contract for structural damages which are a direct result of operator error, gross negligence, or willful misconduct. Damages must be discovered and reported within 3 calendar days of said completion. Upon receipt of written notice The Company shall be allowed 30 calendar days from date of receipt for the purpose of inspecting the premises. Green Emerald Clean, LLC shall have sole option of repairing or contracting repair work to correcting any structural damages that are a direct result of the Company.
Payment Terms
Payment is due at the end of the first day’s work unless alternate arrangements have been made and initialed on the service agreement (see below). Should Client utilize a credit card /debit card for payment, there is a 4% possessing fee will be assessed.
Collection of Outstanding Debt
Green Emerald Clean, LLC reserves the right to attach a mechanic’s lien against a Owner’s property for non-payment. At 30 days past due, a formal notice of intent to file this lien will be sent via registered mail. Interest rate of 7% per month begins accruing after day 31 of non payment. Green Emerald Clean, LLC also reserves the right to enter into civil claims court to collect outstanding debt. All legal fees incurred will be added to the remaining unpaid balance. This contract is binding.
Agreement to Terms
By accepting an estimate, the Client agrees that all the specifications and conditions are satisfactory and hereby accepted. You authorize Green Emerald Clean, LLC to do the work as specified on the proposal/estimate form. You release Green Emerald Clean, LLC. from property damage unless damage is caused by gross negligence or willful misconduct. Green Emerald Clean, LLC is not responsible for damage to lose siding, windows, paint or wood trim. Any damages due to the above are the responsibility of the owner.
